Important limits applying to product and specification information.

1. Purpose and application

This Product and Specification Disclaimer ("Disclaimer") explains how product descriptions, specifications, technical summaries, comparisons, drawings, demonstrations and related information published or supplied by Luminera (Pty) Ltd ("Luminera", "we", "us" or "our") must be understood.

It applies to information appearing on https://lumineraafrica.com, in Luminera's public product catalogue, company profile, brochures, downloadable documents, presentations, emails, quotation discussions and other preliminary communications. It must be read together with the Website Terms of Use, Quote Request Terms, Privacy Notice and the particular written quotation or transaction documents applicable to a project.

2. About Luminera and the information covered

Luminera supplies transparent display, smart film, switchable glass and specialist intelligent-glass technologies sourced from manufacturers. Luminera ordinarily does not hold stock; products are generally selected, configured, manufactured or supplied after customer confirmation and manufacturer availability checks.

The information covered by this Disclaimer includes product-family descriptions, names, model references, dimensions, transparency, brightness, pixel pitch, colour, electrical information, controls, software, compatibility, environmental ratings, diagrams, drawings, performance statements, comparison tables, lead-time indications and warranty summaries.

3. General nature of public product information

Website and catalogue material is intended to help a prospective customer understand broad product categories and possible applications. It is not a project-specific specification schedule, engineering design, bill of quantities, installation method, compliance certificate, professional opinion, manufacturer production approval or guarantee of performance.

A description of a typical use, benefit or application does not mean that every product in that family will be suitable for every site, surface, building, climate, viewing condition, control environment or customer objective. Suitability depends on the exact model, configuration, site information, surrounding systems and written project requirements.

Technical content may be abbreviated, simplified, translated, reformatted or based on manufacturer and supplier information. Luminera takes reasonable care when preparing public material, but errors, omissions, outdated content and differences between preliminary and final manufacturer documents may occur.

4. Project-specific confirmation is required

Before a customer commits to a product, the project should be assessed using the information reasonably required for that stage. Depending on the project, this may include dimensions, quantities, location, intended use, viewing distance, ambient light, indoor or outdoor exposure, substrate or glazing details, electrical supply, controls, content requirements, access, delivery and professional approvals.

Final selection should be based on the formal written quotation and any approved technical schedule, manufacturer confirmation, drawing, data sheet, sample approval or other document expressly identified as applicable to the order. A customer must raise any uncertainty or project-specific requirement before accepting the quotation or approving manufacture.

5. Specifications, models and manufacturer information

Product specifications may differ by manufacturer, model, size, configuration, production batch, destination market and optional component. Manufacturer documents and model names may be revised without immediate notice to Luminera. A public summary may therefore not include every limitation, tolerance, option, dependency or installation condition.

Unless expressly confirmed in a current written quotation or approved schedule, no statement should be treated as a guaranteed value, including a statement about dimensions, transparency, brightness, colour, resolution, pixel pitch, viewing angle, power use, service life, switching speed, acoustic performance, heat performance, environmental rating, software capability or compatibility.

Where a specification is important to the project, the customer must request written confirmation before acceptance. Luminera may obtain manufacturer input and may issue a revised quotation or schedule where additional confirmation changes the product, configuration, price, timing or scope.

6. Product-family and performance variables

Performance observed in one demonstration, sample, showroom, photograph or reference project may not be reproduced identically in another environment. Ambient light, camera exposure, viewing angle, scale, surface, content, electrical supply, calibration, installation quality and surrounding architecture can materially affect appearance and operation.

7. Measurements, quantities and site information

Luminera does not ordinarily perform site surveys or physical measurement. Dimensions, quantities, photographs, drawings and site information supplied by a customer or its representatives may be used for assessment and quotation purposes. The customer and its appointed professionals remain responsible for their accuracy and completeness unless Luminera expressly accepts a specific verification obligation in writing.

Indicative dimensions or quantities must not be used as fabrication, procurement or installation instructions. Before manufacture or supply, the responsible party may need to approve final dimensions, layouts, openings, tolerances, interfaces, fixing details, electrical provisions and delivery constraints.

Changes to dimensions, quantities, product configuration, access, delivery location or site conditions may require a revised quotation, additional manufacturer confirmation and changed lead times.

8. Images, samples, demonstrations and appearance

Images and visual material are used to explain product concepts and possible applications. They may be cropped, colour-corrected, rendered, composited, photographed under controlled conditions or supplied by manufacturers and third parties. Screens and printed documents can also reproduce colours and transparency differently.

• An illustrative visual should be labelled: "Illustrative concept rendering - not a completed Luminera installation."
• A manufacturer or supplier photograph should be labelled: "Supplier reference image."
• A concept rendering, mock-up or supplier image is not a Luminera case study, customer endorsement or guarantee of an identical outcome.
• A physical or digital sample represents only the sample supplied and may not show all production tolerances, batch variations, edges, joins, controls or site effects.

Where colour, transparency, finish, scale or visual appearance is material, the customer should request and approve an appropriate sample, mock-up, manufacturer reference or written specification before manufacture. Any approval process should be recorded in writing.

9. Controls, content, software and compatibility

Display and intelligent-glass products may depend on controllers, power supplies, wiring, networks, operating systems, applications, media players, file formats, software licences, third-party platforms and customer-provided infrastructure. Compatibility must be assessed for the specific configuration and intended workflow.

A statement that a product supports a feature or format does not guarantee compatibility with every device, network, content-management system, cybersecurity policy, file, application or third-party service. Software interfaces and third-party services may change, be discontinued, require updates or be subject to separate terms and licences.

Content design, content production, network administration and on-site system support are excluded unless expressly quoted. Luminera's optional remote content-change plan, where offered, is remote only and is governed by a separate agreement or service-level agreement. It must not be described as a 24/7 service.

10. Environment, safety and regulatory suitability

Product suitability may be affected by temperature, humidity, sunlight, ultraviolet exposure, water, condensation, dust, vibration, cleaning, ventilation, electromagnetic conditions, electrical quality, fire or safety requirements, public access, impact risk and other environmental or operational factors.

The customer and its appointed architects, engineers, contractors and other professionals remain responsible for project-specific design, statutory approvals, building and fire requirements, electrical compliance, structural support, safe access, installation methodology, risk assessment and compliance with applicable laws, standards and site rules.

Manufacturer safety instructions, warnings, manuals and environmental limits must be reviewed and followed. A product must not be used outside its confirmed conditions or modified, installed or operated contrary to applicable instructions.

11. Installation, engineering and professional responsibilities

Unless a formal quotation expressly states otherwise, Luminera supplies products and related manufacturer information but does not undertake site surveys, measurement, architectural or engineering design, installation coordination, installation, commissioning, training, maintenance, repair, on-site support, site safety management or workmanship responsibility.

The client must appoint suitably qualified professionals and contractors where required. Those parties must verify the site, design interfaces and installation requirements, and determine whether the product and proposed use comply with project obligations. Luminera is entitled to rely on written information and approvals supplied by the client and its appointed professionals.

12. Availability, manufacturing, batches and substitutions

Public information does not confirm current stock, production capacity, component availability, price, delivery date or allocation. Products are generally sourced or manufactured after customer confirmation. Availability and lead times remain subject to manufacturer acceptance, payment, final approvals, production conditions, freight, customs and events outside reasonable control.

Manufacturers may discontinue or revise products, components, software or packaging. Batch-to-batch differences and normal production tolerances may occur. Luminera will not substitute a materially different product without an updated written quotation, schedule or other recorded approval process.

Where a proposed product becomes unavailable or unsuitable before order acceptance, Luminera may offer an alternative, revise the quotation or decline to proceed. No alternative is binding until accepted through the applicable written process.

13. Warranties, defects and after-sales matters

Warranty references in public material are summaries only. The applicable warranty is limited to the written manufacturer warranty terms identified for the quoted product, together with any express written commitment made by Luminera and any statutory right or remedy that cannot lawfully be excluded.

Warranty coverage may depend on correct storage, handling, installation, commissioning, operation, maintenance, environmental conditions, electrical quality, approved components and compliance with manufacturer instructions. A warranty may not cover misuse, unauthorised modification, incorrect installation, accident, external damage, unsuitable infrastructure, normal wear or circumstances excluded by the applicable written terms, subject to mandatory law.

A suspected defect, shortage, damage or non-conformity should be reported promptly with the order or project reference, photographs, serial or batch information and other reasonably requested evidence. Reporting and investigation procedures do not remove any non-excludable legal right.

14. Quotations and document priority

Only a formal written quotation issued by an authorised Luminera representative states the commercial offer for a project. The customer must review the product description, model, quantity, dimensions, configuration, inclusions, exclusions, assumptions, price, currency, VAT treatment, delivery scope, lead-time basis, payment terms, validity and warranty reference before acceptance.

Where documents conflict, the specific signed or expressly accepted transaction document and its approved schedules will govern the project to the extent of the conflict, followed by the written quotation and order confirmation. General website, catalogue, brochure, demonstration and discussion content is subordinate to the project-specific written documents.

An order should not proceed until any material technical question, specification dependency or scope uncertainty has been resolved in writing.

15. Reliance, liability and rights preserved

A user must exercise reasonable care and obtain appropriate project-specific confirmation before relying on product or technical information. To the maximum extent permitted by law, Luminera is not responsible for loss arising solely from reliance on general or preliminary material where the user did not obtain required written confirmation, professional advice or site verification.

Nothing in this Disclaimer excludes, restricts or waives any right, remedy, warranty, duty or liability that cannot lawfully be excluded or limited. This includes applicable rights relating to fair marketing, fair terms, safe and good-quality goods, implied warranties, product warnings and harm caused by defective or unsafe goods where those provisions apply.

Any project-specific allocation of risk or responsibility must be stated clearly in the relevant quotation or agreement and remains subject to applicable law. If any part of this Disclaimer is invalid or unenforceable, the remaining parts continue to apply to the extent permitted.

16. Reporting errors and contact details

Please notify Luminera if public product information appears inaccurate, inconsistent, outdated or unclear. Luminera may correct or update content without prior notice. A correction to public material does not automatically amend an already accepted transaction document; any project-specific change must be handled through the relevant written process.

17. Website implementation wording

The following short notices may be used near product pages, comparison tools, technical drawers and downloadable documents. They do not replace this full Disclaimer or project-specific written documents.

18. Approval and version control

This Disclaimer is issued on behalf of Luminera (Pty) Ltd after approval by the founders. It should be reviewed at least annually and whenever Luminera changes product families, suppliers, published claims, warranty wording, commercial scope, website features or applicable legal requirements.
